Understanding Your DUI/APC/DWI Charges in Oklahoma

If you find yourself in trouble with an alcohol or drug related driving offense in Oklahoma, you need an experienced attorney who knows how to protect your rights. That’s where Attorney Josh Davis can help.

In Oklahoma, your charges can depend on a number of things. Generally, most first-time offenses are misdemeanors and are charged as either a DWI, APC, DUI or Aggravated DUI, so long as no one was injured and there wasn’t a child in the car. As a misdemeanor, you can face up to a $1,000 fine and anywhere from 10 days to 1 year in jail. You could face additional requirements like an alcohol assessment and classes as well as having to attend a victim’s impact panel. If your breath test indicates a breath alcohol content above a .15, additional penalties could apply. That’s why it’s important to contact Attorney Josh Davis ASAP after you’ve been arrested.

If you’ve previously been convicted or received a deferred sentence on a DUI or APC within the past 10 years, you could be charged with a felony. Depending on your prior record you could be facing anywhere from up to 5 years to up to 20 years. Felonies can greatly affect your life and it is important to act quickly to hire an attorney who knows what he's doing.

Oklahoma's License Revocation Process

Not only can you face criminal penalties, but Oklahoma law mandates that your driver license should be revoked as well. Luckily there are options available. Remember, just because you were arrested does not mean that your license is automatically revoked. You must first receive a notice from Service Oklahoma notifying you that you have a pending license revocation. You have 40 days from the date of that notice to either sign up for the Impaired Drivers Accountability Program (IDAP) or to file an appeal in District Court. Attorney Josh Davis can help advise you on the proper course of action in your case. There are often issues that can lead to your revocation being set aside and help you avoid the cost and inconvenience of having an interlock device installed.
